United States Victims of State Sponsored Terrorism Fund

The omnibus spending bill passed by Congress and signed into law by President Barack Obama in December 2015 set aside funds to compensate victims of state sponsored terrorism. This led to the creation of the Victims of State Sponsored Terrorism fund that will compensate victims of terrorist attacks with final court judgments against state sponsors of terrorism determined by the Secretary of State. United States Department of State defines these countries under certain sections of the Export Administration Act, Arms Export Control Act, and the Foreign Assistance Act. According to the Consolidated Appropriations Act of 2016 (H.R. 2029), the Victims of State Sponsored Terrorism fund set payment amounts and guidelines for claimants to follow to receive compensation. There is a similar law in the United Kingdom where victims of terrorist attacks abroad can receive compensation. While the European Union has measures in place to help victims of terrorism, they do not offer compensation to them.


Recently, the U.S. Justice Department appointed Kenneth R. Feinberg to be Special Master of the new fund. Feinberg’s previous experience as Special Master includes administering compensation funds in the BP oil spill, September 11th Victim Compensation Fund, Hokie Spirit Memorial, Penn State, Aurora Victim, One Fund Boston, Newton-Sandy Hook, General Motors Car Recall, and most recently the Volkswagen Emission Scandal. According to the bill, after the Special Master is appointed, they will have to publish in the Federal Register and create and maintain a website detailing the procedures for eligibility. Payments to recipients are to start one year after the bill was signed into law.The U.S. Victims State Sponsored Terrorism Fund will receive over $1 billion in appropriations by the Treasury Department for the year 2017, and will also receive funding from a variety of other means. The fund will remain active until January 2, 2026.
