Recently, Fosamax has been under investigation by the FDA for its potential side effects, none of which have been disclosed or warned against by the manufacturer. Some of these potential side effects include nausea, bloating, and other gastrointestinal discomforts; difficulty tasting food and differentiating flavors; bloody vomit; swelling of gums, face, legs, and other body parts; and fever blisters. Other dangers that may be presented by Fosamax are an increased risk for breaking bones. The FDA is also conducting research to discover whether taking bisphosphonates leads to an increased risk of esophageal cancer, but so far, no definitive answers exist.
Multiple lawsuits have been launched against Merck, the manufacturers of Fosamax, by those who have been made sick or suffered fatalities as a result of Fosamax usage. One of the largest cases is made up of 1,140 plaintiffs who alleged that Fosamax led to osteonecrosis of the jaw (ONJ), or the death of a jaw bone. The FDA confirmed in 2004 that Fosamax increases the chances for this condition. In December, 2013, Merck said that it would pay $27.7 million to settle the ONJ suit. This settlement does not cover all of the 5,255 product liability lawsuits facing Merck over Fosamax.
FDA regulations as of 2010 required that Fosamax include warning labels against increased risk of bone fracture or breakage. This warning was released after a 2008 alert that bisphosphonates can cause joint, bone, and muscle pain. There are currently over 4,000 pending lawsuits against Merck. These claims are by and large consolidated into a multi-district litigation.
