The Zimmer Durom Cup hip replacement device was approved in Europe in 2003. The U.S. Food and Drug Administration followed suit in 2006 for total hip replacements. Many who had the Durom Cup device implanted began having severe injuries, including early failure of the system leading to pain and metal poisoning. While the system was temporarily suspended in 2008, it came back into use later on and continued to be associated with various joint injuries, requiring revision surgery and lengthy rehabilitation for hundreds of patients.
In 2010, a Multi-District Litigation was established in the U.S. District Court for the District of New Jersey for plaintiffs alleging severe complications from the Durom Cup device. Over the ensuing years, Zimmer was settling various claims through mediation. A 2012 SEC filing indicated that the company had already paid close to $400 million related to their Durom Cup product. However, claims across the U.S. continued to be filed and transferred into the MDL.
Durom Cup Settlement Program
In 2016, Zimmer announced that they had reached a Settlement Program with the plaintiffs’ lawyers to resolve remaining claims. There are two tracks to the program. The Base Award Program provides $175,000, which can be raised or lowered depending on criteria applying to individual claims. The Fixed Award Program offers $25,000 with no adjustments, and is for claimants in situations that limit their claim value. A website has been established providing more information, the settlement agreement, and claim forms to fill out.
