Future for Funding Litigation When State Aid is Unavailable

Elsa Booth is the managing director of Lexis Nexis in the United Kingdom. She wrote a white paper study for the New Law Journal titled Legal Aid Today: What is the future for funding litigation when state aid is unavailable.

The study discusses civil litigation and possible alternative sources of funding. The report includes information about the use of third party litigation funding in the different European countries. Booth also mentions new ideas to help the civil litigation system like prepaid insurance for legal costs, contingency funds, and increasing use of third party litigation funding.

In one part of the report, the access to justice is questioned, and different ways are discussed in which third party litigation funding can be used to help increase access to the U.K. justice system.
